All Wills Must Go Through Probate

When you pass away, probate happens regardless of whether or not you have a will or estate plan. However, we recommend you create an estate plan to make the process simpler.

What is Probate?

Probate is a court supervised process which authenticates your will and allows your executor to distribute your property.

What Gets Passed on During Probate?

If one of your beneficiaries passes away before you, you need to determine if their share lapses or passes on to their beneficiaries. If your son or daughter dies before you, do they have children or your grandchildren? These questions need to be answered to clarify your estate plan and make sure state law does not provide the answer to these questions.

What Doesn't Have to Go Through Probate?

Many items may not have to go through probate if they are titled jointly owned property or name a specific such as an insurance policy. It is very important to determine how you hold title to your estate property before proceeding with a court probate.

What Happens If There Is No Will?

Without a will the process becomes much more complicated. In this case, it is up to the court to determine how the estate is distributed to the next of kin.
