When you pass away, probate happens regardless of whether or not you have a will or estate plan. However, we recommend you create an estate plan to make the process simpler.

What is Probate?

Probate is a court supervised process which authenticates your will and allows your executor (lawyer) to distribute your property.

What Gets Passed on During Probate?

Any inheritance where the beneficiary passes away before you, non-titled property, and any solo or partner-owned investment property are all things which must always go through probate.

What Doesn't Have to Go Through Probate?

Many of the items which are placed on an estate plan do not have to go through probate, such as certain possessions transferred, jointly owned property, and most items which have a beneficiary named.

What Happens If There Is No Will?

Without a will the process becomes much more complicated. In this case, it is up to the court to determine how the estate is distributed to the next of kin.
